ROUTE AFRICA provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of ROUTE AFRICA are subject to the following terms of service:
Indemnification Policy
You agree to use all ROUTE AFRICA services and facilities at your own risk. ROUTE AFRICA specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall ROUTE AFRICA be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold ROUTE AFRICA harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against ROUTE AFRICA, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless ROUTE AFRICA against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with ROUTE AFRICA's server.
ROUTE AFRICA reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from ROUTE AFRICA's server. ROUTE AFRICA shall be the sole judge of what violates this Policy.
Billing
At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee is nonrefundable).
We accept Visa, Master Card, American Express, Discover Card. For webhosting plans we will setup your account without any paying. Clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.
Acceptable Use Policy
All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended. If you will not pay for service renew in 30 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.
Billing
All services provided by ROUTE AFRICA may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless ROUTE AFRICA and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all ROUTE AFRICA servers. This includes sites that include sexually explicit or hardcore images and/or advertising
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
Banned Scripts
The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.
- IRC egg drops
- Proxy servers
- Mail bombers
- Anonymous mailers
- IP spoofers
- Port scanners
- Hivemail
- Telnet or SSH Access Scripts
- nph-proxy (and other scripts what operates like proxy)
- UBB (Ultimate Bulletin Board, all versions)
- lstmrge.cgi
- phpShell
- FormMail.cgi, FormMail.pl from Matt's Script Archive are not allowed.
LIMITATION OF LIABILITY
ROUTE AFRICA shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from ROUTE AFRICA servers going off-line or being unavailable for any reason whatsoever. Furthermore, ROUTE AFRICA shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of ROUTE AFRICA servers. All damages shall be limited to the immediate termination of service.
DISCLAIMER
ROUTE AFRICA cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by ROUTE AFRICA are resold. Thus, certain equipment, routing, software, and programming used by ROUTE AFRICA are not directly owned or written by ROUTE AFRICA. Moreover, ROUTE AFRICA holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as ROUTE AFRICA sees fit. FURTHERMORE, ROUTE AFRICA retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
Privacy
In an effort to protect our clients' and site visitors privacy and rights, ROUTE AFRICA has established a Privacy Policy which explains what information we gather on visitors and what we do with information that we gather.
This Privacy Policy governs the manner in which ROUTE AFRICA collects, uses, maintains and discloses information collected from users of this Web site (each, a "User").
Users' privacy is very important to ROUTE AFRICA. We are committed to safeguarding the information Users entrust to ROUTE AFRICA.
The Information We Collect
ROUTE AFRICA collects personally identifiable information from Users through online forms for ordering products and services. We may also collect information about how Users use our Web site, for example, by tracking the number of unique views received by the pages of the Web site or the domains from which Users originate. We use "cookies" to track how Users use our Web site.
How We Use Information
ROUTE AFRICA may use personally identifiable information collected through our Web site to contact Users regarding products and services offered by ROUTE AFRICA and its trusted affiliates, independent contractors and business partners, and otherwise to enhance Users' experience with ROUTE AFRICA and such affiliates, independent contractors and business partners. At no time will ROUTE AFRICA's database of users ever be sold to any entity for the purpose of marketing or mailing lists. Personal information will not be sold or otherwise transferred to our business partners without your prior consent, except that we will disclose the information we collect to third parties when, in our good faith judgment, we are obligated to do so under applicable laws.
Backup Policy
You are solely responsible for backing up any data associated with your hosting packages. We strongly recommend that you take periodic backups and store them in a separate location in the event that you need to restore your data for any reason. You may request a backup of the last 7 days (from the date of request) from us and we will try to restore your data from our disaster recovery backups, subject to your payment of backup service fees. These backup services are provided as a courtesy, not an obligation. We do not maintain any backups for VPS, Dedicated servers, Managed Servers, or OX Email.
VPS Terms of Service Addendum
This addendum (“Server Addendum”) also applies to you if you purchased VPS or dedicated server services and are incorporated by reference into the Route Affrica Terms of Service. Unless otherwise stated, defined terms in this Server Addendum have the meanings provided in the Terms of Service. Route Affrica may modify this Server Addendum at any time without notice.
Cancellations and Refunds
- Customers may cancel their VPS services at any time via the Customer/Reseller Control Panel.
- For more information about our money back guarantee and refund policy for VPS services please refer to the Cancellations and Refunds section of our Terms of Service.
Prohibited Uses In addition to any Prohibited Uses outlined in the Acceptable Use Policy, customers may not:
- Utilize the Services to run public IRCd’s or malicious bots.
- Utilize the Services to run any type of BitTorrent client or tracker that links to or downloads illegal content.
- Utilize the Services to run an Open/Public proxy, or use a proxy to access illegal/malicious content.
- Utilize the Services to use I/O intensive applications which adversely affect normal server operations.
- Utilize the Services in any manner which adversely affect normal server operations.
Certain Rights
Route Affrica can take any action to enforce its rights under this Server Addendum or the Route Affrica Terms of Service, which includes but is not limited to, accessing our server by any means, and if required: (i) resetting our server passwords; and/or (ii) suspending User access to our server and/or deleting User access (and thereafter deleting such User’s data from our server).
Route Affrica shall offer support to the User, only if there is a failure with: (i) the hardware of our servers; (ii) the network infrastructure supporting our servers; (iii) the deployment of our servers; (iv) the installation of supported operating systems, if any; and (v) setting up reverse domain name systems for the internet protocol addresses (IPs) given by the Route Affrica.
User is advised to and shall be solely responsible for: (i) handling the reputation of IPs and taking necessary steps to delist any blacklisted IPs; (ii) updating and patching the operating system and applications on our server provided to the User; (iii) making changes to our server that impact the display of information in the Customer/Reseller Control Panel.
Inodes
Generally, accounts may come with a default inode limit of 1,000,000 to better protect the file system; provided, however, that such limit may vary depending on the package or services you purchased.
cPanels Accounts
Our VPS and dedicated server packages include 100 cPanel accounts at no extra charge. However, if you exceed 100 cPanel accounts, you will be billed for each additional cPanel account, at our then current rates.
Mail Policy
VPS accounts will be governed by our Acceptable Use Policy .
Backup and Data Loss
Route Affrica does not provide any backups for VPS servers. Your use of the VPS service is solely at your own risk. Route Affrica is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Route Affrica’s servers.
